You may be thinking, “Weren’t they always legal?” They weren’t.
Raised garden beds, which you can find in so many Newton yards, were considered structures, and structures generally aren’t allowed in required yard setbacks. Inspectional Services wasn’t actively looking for them, but if an inspector encountered one while working on another matter—or if a neighbor filed a complaint—the homeowner could be required to remove it.
It’s a new day: your raised garden beds are now legal.
There are still some rules governing their size, distance from lot lines, coverage of the yard, and the height of their supporting stakes. You can find the details here.
I understand that some people may wonder why the Council spent time on this when Newton has such pressing housing needs. But if you were one of the homeowners told to remove a garden bed, I suspect you would see it differently.
Sometimes good government is also about fixing the small rules that don’t make sense.
